ASBVME ISSUES SUBPOENA TO ALABAMA SPAY/NEUTER VET, DR. WILLIAM WEBER.It was recently reported here that ASBVME Executive Director Tammy Wallace had asked the board’s inspector/investigator, David Phillips, to deliver a letter to one or more of the non-profit spay/neuter clinics, requesting various files and documents. We can now confirm that these reports were accurate. Executive Director Wallace has now elevated her request to a subpoena.On August 7, ASBVME Executive Director, Tammy Wallace, served a subpoena to Dr. William Weber, veterinary practice owner at Irondale’s Alabama Spay/Neuter clinic, commanding him to appear and testify before the board at their August 10th meeting at the Wynfrey Hotel in Hoover, AL.

On the face, the subpoena appears to be a fishing expedition – it states that it is part of an investigation “to determine if any provisions of the Alabama Veterinary Practice Act or its Administrative Code have been violated.”

In February, 2012, Dr. Ronald Welch, in the board’s Examiner newsletter, stated to the state’s veterinarians that “For more than a year now, the Board has conducted a thorough and extensive investigation of several of these facilities that appear to be in non-compliance of the Practice Act.”

Apparently, “thorough and extensive” investigations conducted by this board, under the “leadership” of Dr. Welch and Dr. Pitman, can last years and produce little.

In addition to commanding Dr. Weber to appear before the board and testify, the subpoena commands Dr. Weber to produce the following records and documents:

“1. Any and all documents pertaining to the operations of Eastwood Animal Clinic and/or Alabama Spay/Neuter Clinic, Inc. involving surgeries conducted or supervised by Dr. William B. Weber including but not limited to the surgical logs and controlled substance logs, calendars, and medical information involved any and all surgeries conducted or supervised by Dr. William B. Weber at or on behalf of the Alabama Spay/Neuter Clinic, Inc. from March 20, 2007 to the present.

2. Any and all documents pertaining to the operations of the Eastwood Animal Clinic and/or Alabama Spay/Neuter Clinic, Inc. involving compensation or payments made to Dr. William B. Weber for work performed at or on behalf of the Alabama Spay / Neuter Clinic, Inc. including checks, receipt documents of cash payments, W-2 forms, 1099 forms, income tax documents and information which includes payments for work performed at or on behalf of the Alabama Spay / Neuter Clinic, Inc. from March 20, 2007 to the present.

3. Any and all documents pertaining to the operations of Eastwood Animal Clinic and/or Alabama Spay / Neuter Clinic, Inc. that support the license applications and/or renewal licenses obtained by or on behalf of Dr. William B. Weber, Eastwood Animal Clinic and/or Alabama Spay / Neuter Clinic, Inc. from March 20, 2007 to the present including but not limited to correspondence, memos, notes, e-mail documentation, or other written documentation involved in the issuance of licenses by the Alabama State Board of Veterinary Medical Examiners.”

    Experimentation on any Animal, in just about all cases, is uncalled for. No animal deserves it. Anyone that has seen a frightened animal that is in a lab, being treated as if it has no feelings, would be against experimentation on them.
